Unpaid cheques
Funds must be on your account when issuing a cheque as legislation exists in France in respect of unpaid cheques.
In the case of an unpaid cheque, the bank is compelled to report this to the Bank of France, and to forbid the client in writing to draw any further cheques. This can lead to a customer becoming « interdit bancaire », which forbids a client to draw cheques for a five year period.
In the case of an unpaid cheque, and for a first incident, a customer has 60 days to regularise the situation. Regularisation after the 60 days or any further incident will result in the customer having to pay penalties to the Bank of France.
Strict legislation exists in France which does necessarily apply elsewhere, so do be careful.
